What is JAMMS?

Jamaica Music Society (JAMMS) is an independent, non-profit, performance rights organization that is membership based and represents a wide range of sound recording copyright holders which include small, medium and large independent record labels/record producers, as well as the major international label groups and artist-owned labels.

JAMMS is the only organization in Jamaica established to administer, manage and grant licenses in respect of neighboring rights of its members and affiliated societies and to collect and receive royalties and other monies payable for the exercise of such rights.

Incorporated in July 2006 and operationalized since May 2007, JAMMS administers the broadcasting and public performance rights granted under the Copyright Act to Sound Recording Copyright Owners (SRCOs). SRCOs are normally individual record producers, record labels or record companies.

Why was JAMMS created?

The formation of JAMMS was prompted by the desire for local record producers to band together with international record producers in order to create a full-service or �one-stop-shop� organization treating with the licensing, collection, and distribution of royalties due on account of the rights in the sound recordings of SRCOs (usually an individual record producer, a record label or record company).

JAMMS was established with the collaboration of International Federation of Phonographic Industry (IFPI), the Recording Industry Association of Jamaica (RIAJam) and Jamaica Musical Rights Administration Society (JAMRAS) (now being wound-up), and has been constituted to represent both the international and local repertoire of sound recordings.

Does JAMMS cover downloads?

No. JAMMS only covers performance rights. A download is governed by the reproduction right in sound recordings, which is not subject to the compulsory license and which must be licensed directly from the SRCO, usually the record company or artist.

JAMMS (Jamaica Music Society) is a Collecting Society/Licensing Agency’.

JAMMS was incorporated in 2006 and is a private, non-profit organization established under the Copyright Act of Jamaica, to administer the intellectual property rights granted to ‘Record Producers’, i.e owners of the master sound recordings.

The role of JAMMS’ is to manage the broadcasting and public performance rights of its members, through its role as a ‘licensing agency/collecting society. This involves the granting of licences to music users, including, radio broadcasters, television broadcasters, webcasters, cable operators, clubs operators, restaurants, gyms, party organizers, show promoters etc. This means, all persons or entities that broadcasts or publicly performs sound recordings as part of their activities, requires a JAMMS licence. JAMMS’ role extends, to the collection and distribution of royalties, to its members, on account of royalties paid over from the various music users.

JAMMS was established with the collaboration of the International Federation of Phonographic Industry (IFPI), the Recording Industry Association of Jamaica (RIAJam), among other local interests, and has been constituted to represent both local record producers/labels as well as international recording companies/labels. The organization has a large local membership, ranging from small Record Producers to the very large seminal Producers. It also represents the repertoire of major international recording companies/labels specifically the ‘majors’, SONYBMG, UNIVERSAL, WARNER MUSIC and EMI.
